Seminar on Latest Legal Issues of International Commercial Arbitration held in Shanghai Tower

On June 16, 2016, the “Seminar on Latest Legal Issues of International Commercial Arbitration” hosted by the Specialized Commission of Litigation and Arbitration of AllBright Law Offices was held in Shanghai Tower.



The Seminar was chaired by YAO Xiaohong, Partner of AllBright Law Offices.



Mr. Ma Yi, Chairman of Shanghai International Economy and Trade Arbitration Commission (“SHIAC”) was invited to the Seminar in which he briefly commented on the latest development trend of international commercial arbitration in Shanghai.



Ms. WANG Weijun, Deputy Secretary-General of SHIAC, elaborated the “current status and development trend of foreign-related commercial arbitration” from practical aspect through the detailed interpretation of several classic cases and the benchmarking of Chinese foreign-related arbitration against international arbitration.

  


LIU Jiong, Senior Partner of AllBright Law Offices, made a presentation under the topic of Overlap of Arbitration and Litigation and the Arbitrability of Antitrust Cases that analyzed the issue of jurisdiction when litigation overlaps with arbitration by giving two types of cases of “contractual agreement and tort action” and “arbitration and litigation of IP cases”. Mr. LIU also analyzed the arbitrability of anti-monopoly dispute by interpreting the Anti-Monopoly Law and the specific cases.



Mr. HUANG Wen, Deputy Secretary-General of SHIAC, elaborated on the system innovation and practice of the arbitration rules of the free trade zone (“FTZ”) from perspectives of the objective requirements from the society on the arbitration resolution of FTZ disputes, new idea and new mechanism of FTZ arbitration rules.



In the end, Eric Lui and Heidi Chui from Stevenson, Wong & Co. jointly presented the “Judicial Practice of Provisional Measures of Mainland Arbitration in Hong Kong” by sharing the latest cases and the environment and regulations of Hong Kong arbitration.
