China Released Negative List for Cross-border Services Trade in Hainan

The Special Administrative Measures (Negative List) for Cross-border Trade in Services in Hainan Free Trade Port (2021 Edition) (the “Negative List”), approved by the CPC Central Committee and the State Council, was promulgated on July 23, 2021 by Ministry of Commerce. The Negative List will take effect on August 26, 2021.

 

As the first negative list issued in the field of cross-border service trade, the list sets out the special administrative measures for cross-border provision of services by overseas service providers (through cross-border delivery, overseas consumption, movement of natural persons), covering aspects such as national treatment, market access, local existence, cross-border trade in financial services, etc.

 

The Negative List includes 70 special management measures in 11 industries. Fields not covered in the Negative List shall be subject to administration in Hainan Free Trade Port under the principle of equal treatment for domestic and overseas service providers.
