China Introduces Data Security Law

On June 10, 2021, the Data Security Law of the People’s Republic of China (the “Data Security Law”) was approved during the 29th session of the Standing Committee of the 13th National People’s Congress. The full text was issued on the same day.
The Data Security Law will be applicable to data processing activities and security supervision within China’s territory. Meanwhile, data processing activities outside China’s territory that harm China’s national security or public interests will be pursued and held liable. . Besides, China will establish a “centralized, unified, efficient and authoritative” mechanism for data security risk assessment, reporting, information sharing, monitoring and early warning under the Data Security Law regime.
Pursuant to the Data Security Law, the provisions of the Cybersecurity Law of People’s Republic of China apply to the security management for exporting data collected or produced by the operators of critical information infrastructure inside China’s territory.
The Data Security Law will take effect on September 1, 2021.
