The Guidelines for Foreign Investment in China (2021 Edition) Formally Released by MOFCOM

On November 5, the Special Conference on Promoting Foreign Investment under the 4th China International Import Expo (CIIE) was held in Shanghai. During the meeting, the Ministry of Commerce (“MOFCOM”) formally issued the Guidelines for Foreign Investment in China (2021 Edition) (the “Guidelines”).
The newly released Guidelines include five chapters, namely “Meeting China”, “Investing in China”, “Legal System for Foreign Investment in China”, “Procedures for Foreign Investment” and “Foreign Nationals in China”. On the basis of having retained the basic framework of the previous edition, the new Guidelines introduce adjustments, updates and optimization on data, work procedures, and expressions. The Guidelines comprehensively demonstrate China’s market-oriented and internationalized business environment based on laws, and are intended to serve as a more comprehensive guide for foreign companies to invest in China as well as providing better services for foreign investors to invest, develop and live in China.
According to Li Yong, Deputy Director of the Investment Promotion Agency of MOFCOM, “In the future, MOFCOM will continue to regularly revise and improve this Guidelines based on changes in statistical data, regulations and policies each year, so as to provide more support and better services for foreign investment and operations in China.”
