Newly Revised Maritime Law of the People's Republic of China Takes Effect

On May 1, 2026, the newly revised Maritime Law of the People's Republic of China officially came into force. First promulgated in 1992, this foundational legislation has guided China's shipping industry for over 30 years, and its first comprehensive overhaul marks a landmark milestone in China's maritime legal development.
This revision aligns China's shipping rules with international standards and lays a solid institutional foundation for high-quality industry growth. It restructures the rights and obligations of shipowners, cargo owners, freight forwarders, financial institutions and insurers, systematically resolving long-standing judicial pain points including unclaimed cargo at destination ports, delivery of goods without original bills of lading and unclear limitation periods. Notably, it incorporates rules on electronic transport records for the first time to support digital transformation, and adds a dedicated chapter on ship oil pollution liability with improved compensation and compulsory insurance mechanisms.
The new law fills institutional gaps for international shipping center construction and accelerates the internationalization of China's maritime rules. However, building a globally influential shipping dispute resolution and rule-making center still requires deeper institutional reforms and enhanced international credibility of Chinese maritime rules.
For the industry, the law guides high-quality development by balancing stakeholder interests. SMEs should strengthen compliance, while large enterprises can optimize global business layouts under the new framework.
Going forward, supporting judicial interpretations will further unlock the law's institutional dividends, boosting China's transition from a major shipping country to a leading maritime power and contributing Chinese wisdom to global shipping governance.
