China's First Mediation Rules for Foreign Related IP Disputes Released

On October 29, 2021, China Council for the Promotion of International Trade (CCPIT) released the Mediation Rules for Intellectual Property Disputes of the Mediation Center of the China Council for the Promotion of International Trade/China Chamber of International Commerce (the “Rules”), which then took effect on November 1. This is the first set of rules formulated for the resolution of foreign related IP disputes.
According to the Rules, parties to the disputes may choose services provided in different languages. In addition, the Mediation Center of CCPIT established a joint mediation mechanism with 21 dispute resolution institutions worldwide. The Rules also stipulate details of the procedure including the acceptance of a case, mediation application, appointment of mediators, mediation fees, etc.
