Provisions on Scope of Necessary Personal Information for Common Mobile Applications Issued

In order to implement the provisions of the Cybersecurity Law of the People's Republic of China that “the collection and use of personal information by network operators shall follow the principles of legality, legitimacy and necessity”, and that “network operators shall not collect personal information unrelated to the services they provide”, offices of four departments jointly promulgated the Provisions on the Scope of Necessary Personal Information for Common Mobile Applications (“Provisions”) on March 12, 2021.
The Provisions stipulate that mobile application operators shall not prohibit users from using the applications’ basic functional services on the grounds that such users refuse to allow the collection of non-essential personal information.
The Provisions will take effect from May 1, 2021.
