MOFCOM Introduced Pilot Program relating to Data Protection and Cross-border Transfer

On August 12, 2020, the Ministry of Commerce issued the Pilot Program of Comprehensively Deepening Innovation and Development of Services Trade (“Pilot Program”), which will apply in 28 provinces and cities including Beijing, Tianjin, Shanghai, etc.
The current round of Pilot Program is a “comprehensive enhancement” based on the previous two rounds of pilot programs. It focuses on promoting reform, opening-up and innovation in trade services, and proposes eight pilot tasks and 122 specific measures in three areas.
To promote the high-quality development of services trade, the Pilot Program introduced several measures regarding data, including setting up special international channels for data; carrying out pilot scheme of safety management of cross-border transfer of data; supporting cross-border services based on industrial Internet such as the collection, storage, process, analysis of big data; and encouraging the international cooperation of digital rule-making.
