State Council Published Regulation on Ecological Environmental Monitoring

On November 6th, the State Council released the Regulation on Ecological and Environmental Monitoring (the “Regulation”), which will take effect on January 1, 2026.
The Regulation consists of 49 articles and specifies that ecological and environmental monitoring includes both public monitoring and self-monitoring conducted by enterprises and institutions, requiring monitoring activities to be lawful, scientific, and truthful. It provides that monitoring stations shall be planned in a unified manner and managed by level and category, and that monitoring information for key regions, river basins, sea areas, and cross-jurisdictional zones shall be shared.
Enterprises and institutions are required to install video surveillance and automated monitoring equipment, ensure network connectivity with authorities, establish data quality management systems, and retain original monitoring records for no less than five years. Technical service organizations must file with authorities and conduct services independently and impartially. The Regulation also imposes penalties—including fines of up to RMB 1 million, suspension of operations, and revocation of qualifications—for data falsification, non-compliant equipment, and other violations.
