National People’s Congress Solicits Public Comments on Four Draft Laws Including Legal Liability and Supplementary Provisions Volume of Eco-Environmental Code

On October 28th, the 18th Session of the Standing Committee of the 14th National People’s Congress released four draft laws: the Ecology and Environment Code – Pollution Prevention and Control Section (Second Deliberation Draft), the Legal Liability and Supplementary Provisions Section (Second Deliberation Draft), the Procuratorial Public Interest Litigation Law (Draft), and the Cultivated Land Protection and Quality Improvement Law (Draft), and opened them to the public for comments, with the deadline set for November 26th.
The draft Pollution Prevention Volume of the Eco-Environmental Code covers prevention and control measures for air, water, marine, soil, solid waste, noise, radiation, chemical substances, electromagnetic radiation, and light pollution. It also sets out enterprise obligations related to pollutant discharge permits, emission standards, total emission control for key pollutants, automatic monitoring, information disclosure, emissions trading, environmental protection taxes, and environmental liability insurance.
The draft Legal Liability and Supplementary Provisions Volume further details the administrative, civil, and criminal consequences of environmental violations, including provisions on daily accumulating fines, aggravated or mitigated penalties, joint and several liability, compensation for damages, and procedures for reporting and accountability, thereby defining the applicable penalties and responsible entities for different types of environmental offenses.
