Administrative Measures for National Pharmaceutical Reserves is Newly Revised

On November 17, 2021, six authorities including the Ministry of Industry and Information Technology and the National Development and Reform Commission jointly issued the Administrative Measures for National Pharmaceutical Reserves (Revised in 2021) (the “Administrative Measures”), which took effect on January 1, 2022.
The Administrative Measures define the National Pharmaceutical Reserves as including both Government Reserves and Enterprise Reserves. Government Reserves comprise pharmaceutical reserves at the central and local levels and are subject to the administrative system of hierarchical accountability.
The Central Pharmaceutical Reserve is mainly used to reserve pharmaceutical products that are used for responding to especially serious and major public emergencies and major activities, and acts as a security guarantee for dealing with major activities and pharmaceutical products with a high risk of shortage in supply; and the Local Pharmaceutical Reserve is mainly used to reserve pharmaceutical products that are used for responding to relatively serious and general public emergencies and major activities, to ensure regional security for major activities and pharmaceutical products that are in short supply within the local jurisdiction.
Enterprise Reserves are enterprise inventories established by pharmaceutical enterprises in accordance with the social responsibilities specified by laws and regulations and in combination with the production and operation conditions of pharmaceutical products. The Administrative Measures also provide provisions on the entire process of government procurement and storage of reserved drugs. For example, central medicine reserve units shall be selected and determined by government procurement in principle, and the central medicine storage locations shall be proposed by the Ministry of Industry and Information Technology in combination with the status quo of reserves and actual tasks and be reported to the national medicine reserve management mechanism for determination upon deliberation.
The promulgation of the Administrative Measures will strengthen the state’s management of medicine reserves, and effectively play an important role of medicine reserves in ensuring the public’s use of drugs, preventing major emergencies, and maintaining social security and stability.
