Shanghai Municipal Data Regulation Released

On November 25, 2021, the Standing Committee of Shanghai Municipal People’s Congress issued Shanghai Municipal Data Regulation (“Data Regulation”). The Data Regulation will take effect on January 1, 2022 and consists of 10 chapters, including the following: general principles, protection of data rights and interests, public data, data element market, development and use of data resources, data security, legal liability and supplementary provisions.
As the first comprehensive local regulation on data area issued in the PRC, the Data Regulation is aimed to protect the data-related rights and interests of natural persons, legal persons and unincorporated organizations so as to standardize data processing activities. Meanwhile, the Data Regulation is to promote the orderly and free flow of data, ensure data security, accelerate the formation of data element market, and promote better development of digital economy.
