Since 2016, the National Development and Reform Commission (“NDRC”) investigated dozens of shipping companies against their violations of China anti-monopoly laws activities such as overcharging THC along with the Ministry of Transportation.


Allbright partners Frank Cao and Susan Guo provided comprehensive legal services to United Arab Shipping Company (UASC) for the anti-trust matters.  With Frank Cao’s and Susan Guo’s great efforts, successfully obtained “Suspension of Investigation” for UASC.  According to the relevant laws, if “the undertakings under investigation commits themselves to adopt specific measures to eliminate the consequences of its conduct within a certain period of time which is accepted by the said authority, the authority for enforcement of the Anti-monopoly Law may decide to suspend the investigation. Where the undertaking fulfills its commitments, the authority for enforcement of the Anti-monopoly Law may decide to terminate the investigation.”


A “Suspension of Investigation” without other penalties or punishment is a very good result for clients.
